Welcome aboard. These Terms are the agreement between you and Crewreers for using our app and website. They cover what you can expect from us, what we expect from you, and the important limits on both. Please read them carefully: by creating an account or using the Service, you agree to be bound by these Terms.

1. Agreement and Eligibility

These Terms of Service ("Terms") form a binding agreement between you and EJM Ventures Pty Ltd (ABN 80 696 343 889), a company registered in New South Wales, Australia, trading as "Crewreers" ("we", "us", "our"), governing your use of the Crewreers mobile app and website at crewreers.com.au (the "Service").

By creating an account or using the Service, you confirm that:

You are at least 18 years of age
You can form a legally binding contract
If you use the Service on behalf of a business, vessel or organisation, you have authority to bind that entity, and "you" means both you and that entity

Our Privacy Policy forms part of these Terms. If you do not agree with these Terms, do not use the Service.

2. Definitions

Crew: an individual member using Crewreers to find work or build a professional profile
Operator: a captain, agency, management company, owner or vessel using Crewreers to post roles and find crew
Member: any user of the Service, whether Crew or Operator
Listing: a job or role posted by an Operator
Content: anything you submit to the Service, including profile details, listings, images, messages, reviews and testimonials

3. Your Account

You must provide accurate, current information and keep it up to date
You are responsible for your login credentials and for all activity under your account. Keep your password secure and tell us promptly at support@crewreers.com.au if you suspect unauthorised use
One person, one account, unless we agree otherwise. Do not impersonate anyone or misrepresent your identity, qualifications or experience
You can close your account at any time from the app or by contacting us

4. What Crewreers Is (and Isn't)

Crewreers is an introduction platform, not an employer, recruiter, or agency. We provide the tools for Crew and Operators to find and contact each other. We are not a party to any conversation, application, hiring decision, contract, or employment relationship between members.

Accordingly:

We do not employ Crew, and we do not act as an employment agent for either side
We do not guarantee that any Crew will find work, that any Operator will find crew, or that any listing, applicant or member is genuine, suitable, available or lawful
Any agreement, engagement, wage, contract or arrangement is solely between the members involved. You deal with other members at your own risk
We do not control and are not responsible for the conduct of any member, on or off the platform

5. Identity Verification and Badges

We offer an optional identity verification flow ("Get Verified") operated by our partner Stripe Identity, which can add a Verified badge to your profile. Verification checks that an identity document appears genuine and matches a selfie, and that you are over 18. See our Privacy Policy for how that data is handled.

A Verified badge is a helpful signal, not a guarantee. It does not verify a member's skills, qualifications, character, references, or suitability for any role, and it does not make Crewreers responsible for that member. Always do your own due diligence.

Any member who submits false, fraudulent, or misrepresented information or documents will have their account terminated and may be subject to legal action.

6. Subscriptions, Credits and Billing

Some features require a paid subscription or the purchase of credits. Current plans include:

Crew membership ("Captain's Pick"): a recurring subscription for Crew
Operator membership (e.g. "Marina" tiers): a recurring subscription for Operators
Listing credits: one-off purchases (single, pack, or urgent) that let Operators post roles

Prices, inclusions and current tiers are shown in the app at the point of purchase and may change over time. All prices are in Australian dollars (AUD). Crewreers is registered for GST; displayed prices include GST where applicable, and tax invoices are issued upon payment.

How you're billed

On iOS, purchases are processed by Apple through your App Store account, subject to Apple's terms
Through our website, purchases are processed securely by Stripe. We never store your card details

Credits are consumed when you create a listing, are non-transferable, and (except where the law requires otherwise) are non-refundable once used.

7. Auto-Renewal and Cancellation

Subscriptions renew automatically. Unless you cancel, your subscription automatically renews at the end of each billing period (for example, annually for Crew or monthly for Operators), and the applicable price is charged to your payment method for the next period.

iOS subscriptions renew through your Apple ID. You manage or cancel them in your device's Settings, under Apple ID, then Subscriptions. Cancellation takes effect at the end of the current period
Web subscriptions can be cancelled from your account settings or by contacting us; cancellation takes effect at the end of the current paid period
When you cancel, you keep access until the end of the period you have already paid for. We do not provide pro-rata refunds for partial periods except where required by law

8. Refunds

Your rights under the Australian Consumer Law (and any equivalent laws that apply to you) are not affected by this section. See Section 15 below.

Purchases made through Apple are subject to Apple's refund policy. We cannot process refunds for App Store purchases; you must request these from Apple
Purchases made through our website are covered by our Refund Policy

9. Your Content

You keep ownership of the Content you submit. By submitting Content, you grant Crewreers a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute it solely to operate, provide and promote the Service (for example, showing your profile to other members). This licence ends when you delete the Content or your account, except for copies already shared with other members or retained as required by law or for backups.

You represent that you own or have the rights to the Content you submit, that it is accurate, and that it does not infringe anyone's rights or break any law. We may remove Content that breaches these Terms, but we are not obliged to monitor or review Content.

Reviews and testimonials must be honest and based on genuine experience. Do not post fake, incentivised, retaliatory or misleading reviews.

10. Acceptable Use

When using Crewreers, you must not:

Break any law, or use the Service for anything fraudulent, harmful or deceptive
Post false, misleading or discriminatory listings or profiles, or misrepresent a role, wage or qualification
Harass, abuse, threaten, defame or discriminate against any member
Collect, scrape or harvest members' data, or contact members for purposes unrelated to legitimate crewing (including spam, marketing or recruitment scams)
Circumvent fees, credits or verification, or use the Service to facilitate off-platform arrangements designed to defraud a member
Upload malware, or attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or its systems
Post content that is obscene, hateful, or infringes others' intellectual property or privacy
Use the Service to offer or solicit anything illegal, unsafe, or in breach of maritime or employment law

You can report members or content that breach these Terms via the in-app tools or support@crewreers.com.au.

11. Hiring, Employment and Your Responsibility

Because Crewreers only makes introductions, you are responsible for your own decisions and legal obligations. In particular:

Operators are responsible for verifying a candidate's identity, qualifications, certifications, references and right to work; for complying with all applicable employment, immigration, maritime, tax, work health and safety and anti-discrimination laws; and for the terms of any engagement they offer
Crew are responsible for confirming the legitimacy of an Operator, vessel and role before accepting any position or travelling, and for holding the certifications and visas they represent
Crewreers does not conduct background checks, confirm certifications or licences, verify vessels, or guarantee the accuracy of any member's claims (beyond the limited identity check in Section 5)
Any pay, contract, travel, accommodation or working arrangement is strictly between the members. Crewreers is not liable for them

12. Our Intellectual Property

The Service, including the Crewreers name, logo, branding, software, design and content we create, is owned by EJM Ventures Pty Ltd and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service as intended by these Terms. You may not copy, modify, distribute, sell or create derivative works from any part of the Service without our written permission.

13. Suspension and Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably believe your use poses a risk to other members or to us, or if required by law. We may also modify or discontinue features, or the Service itself, though we will give reasonable notice of material changes where we can.

On termination, your right to use the Service ends. Sections that by their nature should survive (including Content licence, disclaimers, liability, indemnity and governing law) continue to apply. If you have paid for a subscription and we terminate your account without cause, we will refund any unused, pre-paid portion.

14. Disclaimers

Subject to Section 15 and to the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free or secure, that matches will result in work or hires, or that any member, listing or Content is accurate, genuine, lawful or suitable. You use the Service, and deal with other members, at your own risk.

15. Liability and Consumer Rights

Australian Consumer Law: nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded. Where our goods or services come with non-excludable guarantees, our liability for breaching them is limited (at our option) to re-supplying the service or paying the cost of re-supply, to the extent the law permits.

Subject to the above, and to the maximum extent permitted by law:

We are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, opportunity, data or goodwill
We are not liable for the acts, omissions, Content or conduct of any member, or for any dispute, engagement or transaction between members
Our total aggregate liability to you arising out of or related to the Service is limited to the amount you paid to Crewreers in the 12 months preceding the event giving rise to the claim

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless EJM Ventures Pty Ltd and its officers and personnel from any claims, losses, liabilities and reasonable costs (including legal fees) arising out of your Content, your use of the Service, your dealings with other members, or your breach of these Terms or of any law.

17. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. You and Crewreers submit to the non-exclusive jurisdiction of the courts of New South Wales. Nothing in this section limits rights you may have to bring proceedings in your local jurisdiction where the law entitles you to do so.

If you have a problem, please contact us first at support@crewreers.com.au. Most issues can be resolved quickly and informally.

18. Apple App Store Terms

If you download the app from the Apple App Store, the following additional terms apply between you and us, and you acknowledge that:

These Terms are between you and Crewreers (EJM Ventures Pty Ltd) only, not with Apple. Apple is not responsible for the app or its content
Apple has no obligation to provide any maintenance or support for the app
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims are our responsibility, not Apple's
Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability, legal or regulatory, or consumer protection claims
If a third party claims the app infringes their intellectual property, we (not Apple) are responsible for the investigation, defence, settlement and discharge of that claim
You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government list of prohibited or restricted parties
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce them against you

19. General

Changes: we may update these Terms. When changes are material, we will update the effective date and notify you in the app or by email. Continuing to use the Service after changes take effect means you accept them
Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and us about the Service
Severability: if any part is found unenforceable, the rest stays in force
No waiver: if we do not enforce a right, that is not a waiver of it
Assignment: you may not transfer your rights under these Terms without our consent. We may assign ours (for example, in a sale of the business)
